These Terms and Conditions define the contractual terms between users of RisMe (hereinafter referred to as "this application") and JOC-NETWORK inc. [Chapter 1] The Nature of Safety Features
1. Supplementary measures: The SOS notification, earthquake, accident, and fall detection functions of this application are merely supplementary tools and do not guarantee the user's life or safety.
2. No Guarantee: Detection and notifications may not work depending on the device's sensitivity, OS limitations, battery level, and communication conditions. We do not guarantee 100% operation.
3. Prioritize public services: In an emergency, do not wait for notifications from this app; immediately contact your local public emergency services (110, 911, 112, etc.) directly.
[Chapter 2] Bluetooth Mesh Usage and Execution Permissions
1. Communication Mechanism: In offline environments, "Bluetooth Mesh" is used, which relays data between nearby devices. Users consent to their device automatically relaying encrypted data from others.
2. Background Execution: You agree that the app will run in the background to maintain this functionality, and that this will result in battery consumption.
3. Communication Uncertainty: Users understand and acknowledge that there is a risk that messages may not reach their destination due to distance from the communication partner or obstacles.
[Chapter 3] Prohibited matters
Users must not engage in the following actions when using this application:
1. Sending false SOS messages: Sending prank or false emergency messages that cause confusion to rescue agencies or others.
2. Spam and harassment: Advertising, harassment, and acts that violate public order and morals using voice messages or file transfer functions.
3. Analysis activities: Reverse engineering, decompilation, or unauthorized analysis of the communication protocol of this application.
4. Transmitting, posting, or sharing any content related to child sexual abuse and exploitation (CSAE), child pornography, or any content that promotes such activities.
Chapter 4: Exemptions and Limitations of Liability
1. Disclaimer regarding rescue failures, etc.: We shall not be liable, directly or indirectly, for any damages (including injuries, permanent disabilities, death, or emotional distress) resulting from delayed notification, malfunction, false detection, or failure to perform a rescue.
2. Limitation of Liability: Even if our liability is recognized under the law, our liability for compensation will be limited to the amount paid by the user to us in the past 12 months.
3. Force Majeure: We are exempt from liability for damages caused by government restrictions on communications, censorship, natural disasters, or disruption of infrastructure (such as internet shutdowns).
Chapter 5: Privacy and Data Protection
1. Location Information Acquisition: Location information is acquired in the background to improve the accuracy of the SOS function and fall detection. This information will not be used for any purpose other than rescue assistance.
2. Encryption Protection: Voice messages, photos, and files between users are encrypted end-to-end (E2EE). Neither our company nor any third party, including government agencies, can view the content of these communications.
3. Handling of sensitive data: Biometric and behavioral data, such as impact detection data, will be used solely for the purpose of providing the functionality of this service and will be managed appropriately.
4. Adherence to the RisMe CharterThe user is presented with the following when starting the app:RisMeI agree to the Charter and will respect the rights of others.

5. Data Management and Disclaimer This application is a tool for directly exchanging data between devices, and the user is solely responsible for managing the stored data. We do not store data on our servers and therefore assume no responsibility for any loss or damage to data.
6. Limitation of liability in the event of a disputeWe assume no responsibility whatsoever for disputes between users or misuse of data. Furthermore, since the data exists only on each individual device, it is physically impossible for us to provide logs to law enforcement agencies or other relevant parties.
[Chapter 6] Applicable Law and Dispute Resolution
1. Governing Law: The interpretation and application of these Terms and Conditions shall be governed by the laws of Singapore.
2. Dispute Resolution: Any disputes arising in connection with this application shall be subject to the exclusive jurisdiction of the Singapore International Arbitration Centre (SIAC) as the court of first instance or place of arbitration.
The official text of these Terms and Conditions is in English, and translations into other languages, including Japanese, are provided for reference purposes only for the user's convenience. In the event of any discrepancy or inconsistency between the Japanese translation and the English version, the provisions of the English version shall prevail.

NO WARRANTY FOR CRITICAL SAFETY FUNCTIONS THE SERVICE, INCLUDING BUT NOT LIMITED TO SOS ALERTS, EARTHQUAKE, ACCIDENT, AND FALL DETECTION FEATURES, IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL DETECT EVERY EMERGENCY OR THAT NOTIFICATIONS WILL BE DELIVERED TIMELY OR ACCURATELY. THIS APP IS NOT A LIFE-SAVING DEVICE AND IS NOT A SUBSTITUTE FOR OFFICIAL EMERGENCY SERVICES (E.G., 911, 110, 112). YOUR USE OF THE APP IS AT YOUR OWN SOLE RISK.

BLUETOOTH MESH NETWORK CONSENT BY ENABLING OFFLINE FEATURES, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR DEVICE MAY AUTOMATICALLY RELAY ENCRYPTED DATA PACKETS FOR OTHER USERS WITHIN THE MESH NETWORK. THE COMPANY MAKES NO GUARANTEES REGARDING THE RELIABILITY, RANGE, OR SECURITY OF MESH COMMUNICATIONS.
4. GOVERNING LANGUAGE THESE TERMS ARE EXECUTED IN THE ENGLISH LANGUAGE. ANY TRANSLATIONS PROVIDED (INCLUDING JAPANESE) ARE FOR CONVENIENCE ONLY. IN THE EVENT OF ANY DISCREPANCY, THE ENGLISH VERSION SHALL PREVAIL.
